“A grand jury has been investigating Solyndra for at least two months, according to billing records from the law firm defending the bankrupt California solar company.
“Solyndra retained K&L Gates as it faces a federal criminal probe into its handling of a $535 million loan guarantee from the Energy Department.
“According to an 18-page document that K&L Gates filed Friday with the U.S. Bankruptcy Court in Delaware, Solyndra attorneys have been in contact more than two dozen times with the U.S. Attorney's Office, as well as the FBI.
“The K&L Gates invoice — detailing $146,037 in fees...refers multiple times to its attorneys dealing with a grand jury...
“K&L Gates’s attorneys also have handled issues dealing with the FBI, which conducted a surprise raid on Solyndra's Fremont headquarters and company executive offices on Sept. 8.
“Less than a week later...K&L Gates attorneys met to review the FBI search warrants and to ‘confer with company employees regarding Federal Bureau of Investigation seizures’...
“In an email Tuesday, FBI spokeswoman Julianne Sohn confirmed a joint investigation continues with the Energy Department's inspector general. ‘All affidavits remain sealed and we can't comment any further’...
“San Francisco partner Mikal Condon reviewed congressional testimony on Sept. 14, the same day the House Energy and Commerce Oversight and Investigations Subcommittee had originally planned to have Solyndra CEO Brian Harrison and CFO Bill Stover as witnesses. The two executives appeared Sept. 23, but invoked their Fifth Amendment rights and declined to answer any questions...”
