Another Sunday Of Clinton Deception

- September 27, 2015

On Meet The Press, Clinton Had No Clear Answer For New Discrepancies Uncovered From Her Email Scandal

CLINTON CAN'T EXPLAIN NEWLY DISCOVERED EMAIL CHAIN SHE CERTIFIED DID NOT EXIST

Clinton Can't Explain Discrepancy From Newly Discovered Work-Related Email Exchange With David Petraeus, Only Stating "I Wasn't That Focused On My Email Account To Be Clear Here." TODD: "You had said in a written statement under oath that you had turned over everything that you believed you had for the federal records with those 55,000 emails, but we have now discovered an email chain between General Petraeus and yourself that took place a couple of months before these records started. Can you explain the discrepancy there, because it was the same email address that you used while at State that you were using with General Petraeus just two months before you said everything was out there." CLINTON: "Well, everything that we had access to was certainly out there and the reason we know about the email chain with General Petraeus is because it was on a government server, and so from my perspective we have a very thorough review process that we conducted and my attorneys supervised it, they went through everything and what we had available at the time was turned over." TODD: "But I guess what I'm trying to figure out is if you said in March that the email system began in March of '09 yet we have the same email address popping up in January, what, explain that discrepancy?" CLINTON: "There's a transition period. You know, I wasn't that focused on my email account to be clear here." TODD: "Well let me stop you right there. You say you weren't focused on it, except this seemed to be...to put an email server in your house is not a, it's a complicated thing." CLINTON: "Yeah, but it was already there." Despite Certifying To A Federal Judge All Work Related Emails Had Been Turned Over, Officials Found A New Email Chain From A Date Prior To When She Said Her Account Was Created

In August, Clinton Signed A Statement "Declaring 'Under Penalty Of Perjury' That She Has Turned Over To The Government All Of The E-Mails That Were Federal Records" From Her ClintonEmail.com Domain. "Democratic presidential front-runner Hillary Rodham Clinton, facing questions over her use of a private e-mail system while secretary of state, signed a statement over the weekend declaring 'under penalty of perjury' that she has turned over to the government all of the e-mails that were federal records." (Rosalind S. Helderman, "Hillary Clinton Swears: I Turned Over All My Required E-Mails," The Washington Post , 8/10/15)

Officials Have Discovered A Chain Of Work-Related Emails That Clinton Failed To Turn Over. "Officials say the Obama administration has discovered a chain of emails that Hillary Rodham Clinton failed to turn over when she provided what she said was the full record of work-related correspondence as secretary of state." (Bradley Klapper, "Officials: More Work Emails From Clinton's Private Account," The Associated Press , 9/25/15)

The Email Chain, Which Began From Another Email Address Switched To The Domain Used By Clinton's Private Server, ClintonEmail.com, Occurred Prior To The Time She Told Investigators She Switched To The ClintonEmail.com Account. "The Petraeus emails, first discovered by the Defense Department and then passed to the State Department's inspector general, challenge that claim. They start on Jan. 10, 2009, with Clinton using the older email account. But by Jan. 28 - a week after her swearing in - she switched to using the private email address on a homebrew server that she would rely on for the rest of her tenure. There are less than 10 emails back and forth in total, officials said, and the chain ends on Feb. 1." (Bradley Klapper, "Officials: More Work Emails From Clinton's Private Account," The Associated Press , 9/25/15)

  • The New Discovery "Challenges Clinton's Claim That She Has Handed Over The Entirety Of Her Work Emails From The Account." "Officials said they largely pertained to personnel matters and in no way dealt with classified material. But their existence challenges Clinton's claim that she has handed over the entirety of her work emails from the account." (Bradley Klapper, "Officials: More Work Emails From Clinton's Private Account," The Associated Press , 9/25/15)

CLINTON CONTINUED TO SPIN ON WHY THE STATE DEPARTMENT REQUESTED HER EMAILS

Clinton Again Claimed The State Department's Request For Her Records Coincided With That Of All Former Secretaries And Pertained To Record Keeping, Saying "Not In My Records Per Say But In Their Overall Recordkeeping." TODD: "You had said just now in one of your explanations that you provided by these records because state asked of all secretaries of state. As you know there was a report earlier in The Washington Post that said that isn't quite how it happened. In the summer of 2014 they discovered the discrepancy with your records and they wanted to make a request, then it became a formal request of the last four secretaries of state. Can you explain that discrepancy?" CLINTON: "Well, we have explained that. The campaign has explained it." TODD: "What is it?" CLINTON: "When the committee-the I think eighth or ninth committee-investigating Benghazi asked for information from the State Department, they were doing a survey and they found discrepancies in their recordkeeping not in my records per say but in their overall recordkeeping. There were gaps and that's why they sent the letter and that's why we did the overall, you know, comprehensive search for everything. And it got us to the same place-we looked through everything, we gave them everything work related. In fact, we gave them so much they told us they're sending back 1,200 because they were clearly personal and not work related." (NBC's " Meet The Press," 9/27/15)

But State's Request Of Clinton Was Months Before Others, And "Prompted Entirely By The Discovery That Clinton Had Exclusively Used A Private E-Mail System"

"But State Department Officials Provided New Information Tuesday That Undercuts Clinton's Characterization." (Carol D. Leonnig and Rosalind S. Helderman, "State Department's Account Of E-Mail Request Differs From Clinton's," The Washington Post , 9/22/15)

The Request For Clinton's Records Was "Prompted Entirely By The Discovery That Clinton Had Exclusively Used A Private E-Mail System." "They said the request was not about general recordkeeping but was prompted entirely by the discovery that Clinton had exclusively used a private e-mail system. They also said they first contacted her in the summer of 2014, at least three months before the agency asked Clinton and three of her predecessors to provide their e-mails." (Carol D. Leonnig and Rosalind S. Helderman, "State Department's Account Of E-Mail Request Differs From Clinton's," The Washington Post , 9/22/15)

State Department: "In The Process Of Responding To Congressional Document Requests Pertaining To Benghazi, State Department Officials Recognized That It Had Access To Relatively Few Email Records From Former Secretary Clinton. … State Department Officials Contacted Her Representatives During The Summer Of 2014…" "'In the process of responding to congressional document requests pertaining to Benghazi, State Department officials recognized that it had access to relatively few email records from former Secretary Clinton,' State Department spokesman John Kirby said in a statement e-mailed to The Washington Post. 'State Department officials contacted her representatives during the summer of 2014 to learn more about her email use and the status of emails in that account.'" (Carol D. Leonnig and Rosalind S. Helderman, "State Department's Account Of E-Mail Request Differs From Clinton's," The Washington Post , 9/22/15)

Per The State Department's Request, Clinton's Team Was Retrieving Emails Last July. "He cited a July 23, 2014, e-mail in which employees at Platte River Networks, the private company that was then maintaining her server, discussed sending copies of Clinton's e-mails overnight to Cheryl Mills, a longtime Clinton adviser. A spokesman for the company confirmed Tuesday that its workers started pulling Clinton's e-mails to submit to Mills in July 2014." (Carol D. Leonnig and Rosalind S. Helderman, "State Department's Account Of E-Mail Request Differs From Clinton's," The Washington Post , 9/22/15)

But The State Department Made No Requests Of Other Secretaries Of State Until Months Later. "Kirby added that the agency then recognized 'that we similarly did not have extensive email records from prior Secretaries of State and therefore included them when we requested their records in October 2014.'" (Carol D. Leonnig and Rosalind S. Helderman, "State Department's Account Of E-Mail Request Differs From Clinton's," The Washington Post , 9/22/15)

CLINTON CALLED CHARGES SHE USED A SECRET SERVER TO AVOID OPEN RECORDS LAWS A "CONSPIRACY THEORY"

Clinton Claimed Charges She Used Server To Avoid Open Records Laws "Another Conspiracy Theory." TODD: "Can you respond to an alternative explanation that has sort of…" CLINTON: "Another conspiracy theory?" TODD: "That-that perhaps the reason you wanted to have a private server and not a government server is that republicans have been coming after you for years. You might have-may have been running for president in the future and you wanted to make it a little more difficult for congressional investigators to subpoena your government e-mails and more difficult for freedom of information act requests. Is that a fair theory or no?" CLINTON: "It's totally ridiculous. That never crossed my mind." (NBC's " Meet The Press," 9/27/15)

Clinton's Use Of A Secret Server And Private Email Account Shielded Her Emails From Open Records Law Searches

Clinton's Private Email Account "Shielded" Her Emails From The State Department Record Searches. " The department eventually responded, furnishing House committees with thousands of documents. But it turns out that that was not everything. The State Department had not searched the email account of former Secretary of State Hillary Rodham Clinton because she had maintained a private account, which shielded it from such searches, department officials acknowledged on Tuesday." (Michael S. Schmidt and Amy Chozick, "Using Private Email, Hillary Clinton Thwarted Record Requests," The New York Times , 3/3/15)

  • An Examination Of Freedom Of Information Act Requests Sent To The State Department "Reveal" How Clinton's Use Of A Private Email Account "Protected A Significant Amount Of Her Correspondence From The Eyes Of Investigators And The Public." "But an examination of records requests sent to the department reveals how the practice protected a significant amount of her correspondence from the eyes of investigators and the public. Mrs. Clinton's exclusive use of personal email for her government business is unusual for a high-level official, archive experts have said." (Michael S. Schmidt and Amy Chozick, "Using Private Email, Hillary Clinton Thwarted Record Requests," The New York Times , 3/3/15)

Clinton "Took No Steps" Necessary To Abide By Federal Regulations Requiring That All Emails Be Preserved As Part Of The State Departments Record-Keep System. "Federal regulations, since 2009, have required that all emails be preserved as part of an agency's record-keeping system. In Mrs. Clinton's case, her emails were kept on her personal account and her staff took no steps to have them preserved as part of State Department record." (Michael S. Schmidt and Amy Chozick, "Using Private Email, Hillary Clinton Thwarted Record Requests," The New York Times , 3/3/15)

In 2001, Clinton Said She Had Chosen Not To Use Email To Avoid A Paper Trail For Investigators

Back In 2001, Clinton Had "Chosen To Avoid Email For Fear Of A Paper Trail." "Footage from a 2001 report by ABC News' Brian Ross about a disgruntled donor shows then-Sen. Clinton talking about how she had chosen to avoid email for fear of a paper trail." (Liz Kreutz and Meghan Keneally, "What Hillary Clinton Said About Email In 2000," ABC News, 3/5/15)

  • Clinton: "As Much As I've Been Investigated … Why Would I Ever Want To Do E-Mail?" "'As much as I've been investigated and all of that, you know, why would I -- I don't even want -- why would I ever want to do e-mail?' she's seen on tape telling Peter Paul on home video captured at a fundraiser. 'Can you imagine?' she said." (Liz Kreutz and Meghan Keneally, "What Hillary Clinton Said About Email In 2000," ABC News, 3/5/15)
