Former Secretary Of State Hillary Clinton Struggles To Answer Questions On Her Handling Of The Benghazi Attack And Her Ongoing Email Scandal

CLINTON WAS GRILLED ON HER HANDLING OF BENGHAZI AND WHETHER IT WAS HER 3:00 AM PHONE CALL

Asked If The Benghazi Attack Was Her 3:00 AM Phone Call, Clinton Cited Her Work In "Trying To Protect Our People After The Attack On The Consulate, Getting Them Evacuated ..." JOHN DICKERSON: "Let me take you back to the 2008 campaign where Iraq was a conversation, U.S. security was a conversation. You ran an ad, the 3:00 a.m. ad, which became quite famous. Let's play that for our viewers." HILLARY CLINTON: "My gosh, I haven't seen that in a long time." DICKERSON: "It's a throwback Sunday here, Secretary Clinton." [2008 Hillary Clinton Ad] DICKERSON: "The question for you is now you've been secretary of state. Benghazi. Was that your 3:00 a.m. phone call and how well did you handle that crisis by the standard you raised in that ad?" CLINTON: "Well of course it was a crisis and we lost four brave Americans, including the person that I asked the president to send as ambassador, Chris Stevens. But we live in a dangerous world and even our diplomats are at threat and that goes all the way back to, for goodness sakes, taking over our embassy in Tehran or the bombings of our embassy in Beirut when President Reagan was in charge. This is a dangerous world. And I think what we had to do during that period of time in trying to protect our people after the attack on the consulate, getting them evacuated, not only working on what was going on in Libya, because remember we had embassies that were under attack or threatened to attack by terrorist groups across North Africa, indeed across a much larger swath of the world. So I think it was terribly tragic what happened. I immediately asked for an independent review, just like former secretaries of state did." (CBS's " Face The Nation," 9/20/15)

But During Her 3:00AM Moment, Clinton Actually Left The State Department And Went Home Before The Second Attack On The CIA Compound

Clinton Left The State Department And Went Home Before The Second Attack On The CIA Annex Facility. CLINTON: "With our DS agents at the heavily fortified CIA post and our reinforcements from Tripoli on the ground at the airport, I decided to move from the office to my home in northwest Washington, only minutes away from Foggy Bottom. I knew the days ahead were going to be taxing on us all, with the entire Department looking to me to lead them through this shocking tragedy while keeping everyone focused on what lay ahead. When I became Secretary the Department outfitted my house with all the secure communications and other equipment necessary to work as easily from there as I could from the office." (Hillary Clinton, Hard Choices, 2014)

CLINTON FALSELY CLAIMED OTHERS USED A PRIVATE SERVER, BUT COULDN'T NAME AN OFFICIAL WHO HAD

Clinton Claimed Her Emails Arrangement Was Done By Others But When Pressed Couldn't Name Other Officials Who Exclusively Used Personal Email And A Private Server. DICKERSON: "Some people who know you and have worked with you say what this e-mail situation suggests is that there's nobody around you who can say, Secretary Clinton, this is a bad idea, don't do this, do you have such a person?" CLINTON: "I have too many, actually." DICKERSON: "No before the fact not after. After everybody has giving you advice." CLINTON: "John this is done by higher government officials including…" DICKERSON: "But not at this level. Not solely a server just for you." CLINTON: "You know, look, it was done by others. Let me just say that, yes, when I did it, it was allowed, it was above board. And you know, now I'm being transparent as possible more than anybody else ever has been." Federal Judge: Clinton's Private Email "Did Not Comply With Government Policies"

Clinton's Exclusive Use Of A Personal Email Account "Did Not Comply With Government Policies." "A federal judge on Thursday said that Hillary Rodham Clinton did not comply with government policies in her exclusive use of a personal email account while she was secretary of state, challenging her longstanding position that she abided by the rules." (Michael Schmidt, "Judge Says Hillary Clinton Didn't Follow Government Email Policies," The New York Times, 8/20/15)

  • Judge Emmet G. Sullivan Stated "We Wouldn't Be Here Today If The Employee Had Followed Government Policy." "At a hearing for a Freedom of Information Act lawsuit against the State Department, the judge, Emmet G. Sullivan of Federal District Court for the District of Columbia, said that 'we wouldn't be here today if the employee had followed government policy.'" (Michael Schmidt, "Judge Says Hillary Clinton Didn't Follow Government Email Policies," The New York Times, 8/20/15)

Judge Sullivan Has Also Ordered The State Department To Contact The FBI To Determine If The Server "Contains Official Records Possibly Responsive To The FOIA Suit." "Sullivan's said Clinton's actions had complicated the State Department's ability to respond to requests for records on various topics. He also ordered the State Department to contact the FBI to determine whether the private server Clinton used, which Clinton turned over to that law enforcement agency earlier this month, contains official records possibly responsive to the FOIA suit." (Josh Gerstein, "Judge Says Hillary Clinton's Private Emails Violated Policy," Politico, 8/20/15)

Clinton Used A Private Server To Conduct Official Business

Clinton Exclusively Used A Personal Email Account As Secretary Of State. "Hillary Rodham Clinton exclusively used a personal email account to conduct government business as secretary of state, State Department officials said, and may have violated federal requirements that officials' correspondence be retained as part of the agency's record. Mrs. Clinton did not have a government email address during her four-year tenure at the State Department. Her aides took no actions to have her personal emails preserved on department servers at the time, as required by the Federal Records Act." (Michael Schmidt, "Hillary Clinton Used Personal Email Account at State Dept., Possibly Breaking Rules," The New York Times , 3/2/15)

  • "Mrs. Clinton Did Not Have A Government Email Address During Her Four-Year Tenure At The State Department." (Michael Schmidt, "Hillary Clinton Used Personal Email Account At State Dept., Possibly Breaking Rules," The New York Times , 3/2/15)

The Use Of A Private Server Gave Clinton "Impressive Control Over Limiting Access To Her Message Archives." "The highly unusual practice of a Cabinet-level official physically running her own email would have given Clinton, the presumptive Democratic presidential candidate, impressive control over limiting access to her message archives." (Jack Gillum, "Clinton Ran Homebrew Computer System For Official Emails," The Associated Press , 3/4/15)

  • Operating Her Own Server Afforded Clinton Additional Legal Opportunities To Block Government Or Private Subpoenas. "Operating her own server would have afforded Clinton additional legal opportunities to block government or private subpoenas in criminal, administrative or civil cases because her lawyers could object in court before being forced to turn over any emails." (Jack Gillum, "Clinton Ran Homebrew Computer System For Official Emails," The Associated Press , 3/4/15)

Clinton Handed Over Her Emails After They Were Requested By The State Department

Clinton Turned Over Emails From Her Secret Server Nearly Two Years After Leaving The State Department. "In October, the State Department sent a letter to Mrs. Clinton and all former secretaries of state back to Madeleine K. Albright, seeking emails and other documents in their possession that related to their government work. Finally, in December, dozens of boxes filled with 50,000 pages of printed emails from Mrs. Clinton's personal account were delivered to the State Department. Those documents were then examined by department lawyers, who found roughly 900 pages pertaining to the Benghazi attacks." (Michael S. Schmidt, "Hillary Clinton Asks State Department To Vet Emails For Release," The New York Times , 3/5/15)

  • In November 2014, The House Select Committee On Benghazi Requested Clinton's Emails Related To The Benghazi Attack After Receiving Emails From The State Department In August 2014 Compiled From Other State Department Accounts. "November 2014: The House Select Committee investigating Benghazi requests Mrs. Clinton's emails about the September 2012 incident at Benghazi, Libya, that killed U.S. ambassador Christopher Stevens and three other Americans. About 300 of Mrs. Clinton's emails from her private account were delivered to the committee, her office said. The State Department had by then delivered a separate batch of Mrs. Clinton's emails to the committee in August 2014. Those messages were harvested from other state.gov accounts, Mrs. Clinton's office said." (Reid Epstein, "Timeline: Hillary Clinton's Email Chain," The Wall Street Journal," 3/10/15)

On December 5, 2014, Clinton Turned Over 55,000 Pages Of Emails That Her Office Deemed Work-Related By Using Various Search Terms. "Dec. 5, 2014: Mrs. Clinton's office delivers 30,490 printed emails, about 55,000 pages, to the State Department. Mrs. Clinton's office said 31,830 emails on her account from her tenure as secretary were deemed private and not delivered. To determine which emails should be delivered to the State Department, Mrs. Clinton's office sorted first by all messages to or from a .gov email address, then searched for names of State Department and other government officials. Mrs. Clinton's email cache was also searched for messages that included terms like 'Benghazi' or 'Libya,' her office said."
