FACT CHECK: In Nevada, Clinton Doubles Down On False Email Spin

RNC Communications - August 19, 2015

How long until Joe Biden announces? In hostile exchange with reporters Tuesday that ended with her leaving with her hands in the air, Hillary Clinton spent more than 7 minutes trying to defend her secret email server and the potential mishandling of classified information. But instead of coming clean, Clinton doubled down on her false email spin and reinforced why a growing majority of Americans find her to be dishonest and untrustworthy.

The truth is, Hillary Clinton has been trying to hide the facts since she was sworn in as Secretary of State and has gone to extraordinary lengths to avoid transparency and accountability. If it were not for the House Select Committee on Benghazi and a handful of dogged reporters, we may never have known any of what was going on.

SUNDAY IN IOWA, HILLARY CLINTON FALSELY CLAIMED IF SHE HADN’T ASKED FOR HER EMAILS TO BE RELEASED, “NONE OF THIS WOULD HAVE BEEN IN THE PUBLIC ARENA”

In An August 17 NPR Interview, Clinton Said “And In A Way, It’s Kind Of A Interesting Insight Into How The Government Operates. Because If I Had Not Asked For My Emails All To Be Made Public, None Of This Would Have Been In The Public Arena.” CLINTON: “No, no, look, I understand why people are confused about this, it’s a very confusing issue. I think there’s just a couple things that people need to know, which is, I did what other Secretaries of State have done. I was permitted to and used a personal email and, obviously in retrospect, given all the concerns that have been raised, it would have been probably smarter not to. But I never sent nor received any classified email, nothing marked ‘Classified.’ And I think this will all sort itself out. And in a way, it’s kind of a interesting insight into how the government operates. Because if I had not asked for my emails all to be made public, none of this would have been in the public arena. But I want people to know what we did, I’m proud of the four years I was Secretary of State. So I know this is all just going to work itself out as we go forward.” (Hillary Clinton, Interview With Clay Masters, NPR, 8/17/15)

FACT CHECK: Clinton’s Emails Are Being Released By The State Department Under Court Order

The Wall Street Journal Headline: “Judge Orders Clinton Emails Released On A Rolling Basis” (Byron Tau and Peter Nicholas, “Judge Orders Clinton Emails Released On A Rolling Basis,” The Wall Street Journal, 5/19/15)

A Federal Judge “Instructed The State Department To Release Former Secretary Of State Hillary Clinton’s Emails On A Rolling Basis Rather Than All At Once After They Have Been Cleared.”  “A federal judge on Tuesday instructed the State Department to release former Secretary of State Hillary Clinton’s emails on a rolling basis rather than all at once after they have been cleared.” (Byron Tau and Peter Nicholas, “Judge Orders Clinton Emails Released On A Rolling Basis,” The Wall Street Journal, 5/19/15)

The Judge “Instructed The State Department To Come Up With A New Schedule For The Release Of The Email Archive, Which Has Become The Target Of Multiple Lawsuits Seeking Their Release.” “At a court hearing on Tuesday, federal District Court Judge Rudolph Contreras instructed the State Department to come up with a new schedule for the release of the email archive, which has become the target of multiple lawsuits seeking their release.” (Byron Tau and Peter Nicholas, “Judge Orders Clinton Emails Released On A Rolling Basis,” The Wall Street Journal, 5/19/15)

“The State Department Said It Would Comply With The Court Order To Provide A Plan For The Release Of Mrs. Clinton’s Emails…” “The State Department said it would comply with the court order to provide a plan for the release of Mrs. Clinton’s emails as well as a deadline for when it would release emails related to the Benghazi attacks.” (Byron Tau and Peter Nicholas, “Judge Orders Clinton Emails Released On A Rolling Basis,” The Wall Street Journal, 5/19/15)

  •          “‘We Take Our Legal Obligations Seriously,’ Spokesman Jeff Rathke Said.” (Byron Tau and Peter Nicholas, “Judge Orders Clinton Emails Released On A Rolling Basis,” The Wall Street Journal, 5/19/15)

FACT CHECK: Congressional Investigators Are Responsible For “Much Of What The Public Now Knows” About Clinton’s Emails

“Much Of What The Public Now Knows” Is The Result Of The Investigation Led By The Select Committee On Benghazi. Much of what the public now knows about Clinton’s e-mails comes as a result of a Republican-led House oversight investigation into the State Department’s handling of the 2012 terrorist attack on the U.S. diplomatic compound in Benghazi, Libya. (Carol D. Leonnig, Karen Tumulty and Rosalind S. Helderman, “Clinton’s Team Went From Nonchalant To Nervous Over E-Mail Controversy,” The Washington Post, 8/14/15)

FACT CHECK: The Existence Of Hillary Clinton’s Secret Email Server Was Uncovered By The Associated Press

“The AP Was First To Identify Clinton’s Private Email Server …” “The AP was first to identify Clinton's private email server and trace it in March to her family's home in New York. The server was surrendered to the FBI last week, months after Clinton said it was her personal property and wouldn't be turned over.” (Stephen Braun, “US: Up To 305 Clinton Emails Might Have Classified Data,” The Associated Press, 8/18/15)

FACT CHECK: The State Department Has Been Stonewalling Requests For Clinton’s Records For Years

FOIA Requests From The AP And Other News Organizations Had Sought Clinton’s Emails For Years. “But the Associated Press and other news organizations had sought copies of Clinton's emails under the U.S. Freedom of Information Act for years.” (Stephen Braun, “US: Up To 305 Clinton Emails Might Have Classified Data,” The Associated Press, 8/18/15)

UNDER CLINTON THE STATE DEPARTMENT WAS ONE OF THE LEAST TRANSPARENT CABINET AGENCIES IN THE FEDERAL GOVERNMENT

CNN Headline: “Report: Clinton State Dept. One Of Least Transparent Agencies” (Chris Moody, “Report: Clinton State Dept one of least transparent agencies,” CNN, 3/10/15)

  •          CNN: “When Hillary Clinton Stepped Down As Secretary Of State In 2013, She Left An Agency That Has One Of The Most ‘Dismal’ Transparency Records In The Federal Government.” (Chris Moody, “Report: Clinton State Dept One Of Least Transparent Agencies,” CNN, 3/10/15)
  •          The Non-Partisan Center For Effective Government Gave The Clinton State Department An ‘F’ For Transparency During Her Final Two Years In Office. For both years, the group's report gave State an "F" grade, calling the agency "a serious outlier," compared to other agencies. (Chris Moody, “Report: Clinton State Dept One Of Least Transparent Agencies,” CNN, 3/10/15)
  •          Responding To FOIA Requests Was “Not A Primary Concern During Her Tenure At State.” Still, the report's authors suggest that transparency and responding to FOIA requests was not a primary concern during her tenure at State. "I can definitely say that during her time at the agency, it wasn't a priority," said Sean Moulton, the Center for Effective Government's Open Government Policy. (Chris Moody, “Report: Clinton State Dept One Of Least Transparent Agencies,” CNN, 3/10/15)
