CLINTON CLAIMS SHE COMPLIED WITH EVERY RULE AND REGULATION, BUT HER FAILURE TO TURN OVER TWO MONTHS OF EMAILS PROVES OTHERWISE

Clinton's Attorney Admits That Clinton Has Not Turned Over Any Emails From Her First Two Months As Secretary Of State

Emails From The First Eight Weeks Of Clinton's Tenure As Secretary Of State "Are Missing And Have Been Lost." "As a result of the migration, emails from the first eight weeks of her tenure are missing and have been lost, her representatives acknowledge." (Byron Tau, "Bid To Find Early Clinton State Department Emails Unsuccessful, Lawyer Says," The Wall Street Journal , 10/22/15)

An Attorney For Clinton Admitted That Clinton Did Not Turn Over Any Emails From Her First Two Months As Secretary Of State. "An attorney for former Secretary of State Hillary Clinton said this month that efforts to obtain lost email records from early in her tenure have been unsuccessful. The 30,000 emails turned over to the State Department last year didn't include any emails from her first two months as secretary of state due to technical issues in setting up Mrs. Clinton's personal email server." (Byron Tau, "Bid To Find Early Clinton State Department Emails Unsuccessful, Lawyer Says," The Wall Street Journal , 10/22/15)

An Email Exchange Between Clinton And Gen. David Petraeus Confirms That Clinton Sent Emails During That Period. "[Undersecretary of State for Management Patrick Kennedy] indicated his latest inquiry was prompted by State's discovery that one or more other officials exchanged emails with Clinton between January and March 2009, even though she produced no email records before March 18, 2009. State has confirmed that it now has an exchange Clinton had with Gen. David Petraeus during that period in part on her private clintonemail.com address." (Josh Gerstein, "Lawyer: Clinton 'Unable To Obtain' Emails From First Week As Secretary," Politico , 10/22/15)

Clinton Claims That She Has "Fully Complied With Every Rule" Regarding Her Emails

Clinton, On Turning Over Her Emails: "I Fully Complied With Every Rule That I Was Governed By." QUESTION: "Why did you wait two months? Why -- why did you wait two months to turn those emails over? The rules say you have to turn them over... "(CROSSTALK) HILLARY CLINTON: "I don't think -- I'd be happy to have somebody talk to you about the rules. I fully complied with every rule that I was governed by." (Hillary Clinton, Remarks At The United Nations , New York, NY, 3/10/15)

According To The Federal Records Act And State Department Regulations, Emails That Are Work Related Must Be Preserved

Federal Law States That Agencies That Allow Federal Employees To Use Non-Government Email Systems Must Ensure That Federal Records Are Preserved In The Appropriate Recordkeeping System. "Agencies that allow employees to send and receive official electronic mail messages using a system not operated by the agency must ensure that Federal records sent or received on such systems are preserved in the appropriate agency recordkeeping system." ( 36 C.F.R. 1236.24(b), Accessed 10/22/15)

State Department Regulations Stated That All Emails That Qualify As Federal Records Must Be Preserved.
