Top Clinton Spox Falsely Claims Secret E-Mail "Was Permitted Under Guidelines"

RNC Communications - August 19, 2015

Earlier on MSNBC today, Clinton’s top spokesperson claimed Hillary Clinton’s secret email “was permitted under their guidelines” at the State Department. False. Not only did Clinton’s set up violate State Department regulations, it also violated the White House’s email guidelines as well.  It’s hard to see how Hillary Clinton arrests her plummeting poll numbers when she and her campaign continuously make false statements that only reinforce why a growing majority of Americans find her to be dishonest and untrustworthy. See the fact check from the RNC below:

FACT CHECK: CLINTON WAS IN VIOLATION OF STATE DEPARTMENT EMAIL REGULATIONS FOR NEARLY 6 YEARS

Politico Headline: “Clinton Private Email Violated 'Clear-Cut' State Dept. Rules” (Josh Gerstein, “Clinton Private Emails Violated ‘Clear-Cut’ State Dept, Rules, Politico, 3/5/15)

  • In 2009, The U.S. Code Was Updated To Mandate That Emails Not Sent On Official Systems Be Turned Over To The Appropriate Agency Be Preserved.  “Oct. 2, 2009: The U.S. Code of federal regulations on handling electronic records is updated: ‘Agencies that allow employees to send and receive official electronic mail messages using a system not operated by the agency must ensure that Federal records sent or received on such systems are preserved in the appropriate agency recordkeeping system.’ The responsibility for making and preserving the records is assigned to ‘the head of each federal agency.’” (Glenn Kessler, “Hillary Clinton’s Emails: A Timeline Of Actions And Regulations,” The Washington Post, 3/10/15)

Clinton Did Not Hand Over Work Related Emails Until Nearly Two Years After Stepping Down In Early 2013. "It was only two months ago, in response to a new State Department effort to comply with federal record-keeping practices, that Mrs. Clinton's advisers reviewed tens of thousands of pages of her personal emails and decided which ones to turn over to the State Department. All told, 55,000 pages of emails were given to the department. Mrs. Clinton stepped down from the secretary's post in early 2013." (Michael S. Schmidt, "Hillary Clinton Used Personal Email Account At State Dept., Possibly Breaking Rules," The New York Times , 3/2/15)

FACT CHECK: CLINTON’S SECRET EMAIL ALSO VIOLATED WHITE HOUSE EMAIL GUIDELINES

Washington Post Headline: “White House Says Clinton Did Not Heed E-Mail Policy” (Karen Tumulty & Anne Gearan, “White House Says Clinton Did Not Heed E-Mail Policy,” The Washington Post, 3/4/15)

  • Clinton Operated “In Violation Of What The White House Said … Was ‘Very Specific Guidance.’” Former secretary of state Hillary Rodham Clinton appears to have operated in violation of what the White House said Tuesday was “very specific guidance” that members of the Obama administration use government e-mail accounts to carry out official business.
